Terms of service

1. Subject and definitions
These Terms of service (the "Terms") govern access to and use of the zeroCO2 monitoring portal (the "Service"), provided by Energy S.p.A., with registered office in Piazza Manifattura n. 1, 38068 Rovereto (TN), Italy, VAT number IT02284640220 (the "Provider"). The Service includes the web application, the mobile applications and the data access tools made available by the Provider, including the EnergyInCloud connector for third-party artificial intelligence assistants.
For the purposes of the Terms:
- "User" is the natural or legal person holding an Account;
- "Account" is the access profile to the Service;
- "Plant" is the photovoltaic plant, with or without storage, of the zeroCO2 Hybrid Inverters or zeroCO2 XL product families associated with the Account;
- "Tools" are the functions for consulting and, where provided, changing data exposed by the Service;
- "AI Provider" is the third party offering an artificial intelligence assistant that can be connected to the Service.
2. Access and Account
Owners or operators of Plants, installers and authorised distributors may register with the Service. Credentials are personal and non-transferable; the User is responsible for keeping them safe and for any activity carried out through their Account, and undertakes to report any unauthorised use without delay. The Service is not intended for persons under 18.
3. Licence and prohibited uses
The Provider grants the User a non-exclusive, non-transferable and revocable licence to use the Service to monitor and manage their own Plants, for personal use or within their business. It is prohibited to:
- extract data automatically outside the Tools provided;
- circumvent access controls or role restrictions;
- resell or grant third parties access to the Service;
- decompile or alter the software;
- generate abnormal load or otherwise interfere with the operation of the Service.
4. Access through third-party artificial intelligence assistants
The User may connect an artificial intelligence assistant offered by an AI Provider of their choice to their Account. The connection is made on the User's initiative; the User accepts the AI Provider's terms and may revoke the connection at any time. The Service exposes to the assistant only the data of the Plants of the Account, within the permissions of the User's role.
The assistant's answers are generated by the AI Provider from the data supplied by the Service and may contain errors, omissions or incorrect interpretations. They do not constitute technical assistance, fault diagnosis or advice of any kind. The Provider is not a party to the relationship between the User and the AI Provider and has no partnership, sponsorship or endorsement relationship with AI Providers.
5. Nature of the information
The Service shows data measured by the Plants and, where indicated, estimates. Economic estimates state the assumptions used and do not constitute financial, tax or technical advice. Monitoring does not replace the periodic maintenance of the Plants or the safety checks required by law.
6. Availability and changes to the Service
The Service is provided "as is" and "as available". The Provider does not guarantee the continuity of access through artificial intelligence assistants, which also depends on the AI Provider's systems. The Provider may change, suspend or withdraw functions and Tools, giving reasonable notice of substantial changes.
7. Personal data
The processing of personal data is described in the Service's Privacy policy, which forms an integral part of the Terms.
8. Intellectual property
The software, the Energy, zeroCO2 and EnergyInCloud trademarks, the documentation and all other content of the Service belong to the Provider or its licensors. Nothing in the Terms transfers any rights in them to the User. The public connector for artificial intelligence assistants is distributed under the licence stated in its repository.
9. Liability
To the maximum extent permitted by law, the Provider is liable only for direct damages arising from wilful misconduct or gross negligence, excluding indirect damages, loss of profit and loss of data. The Provider is not liable for decisions taken by the User on the basis of an artificial intelligence assistant's answers, nor for the conduct of AI Providers. The mandatory protections granted by law to consumers remain unaffected.
10. Suspension and termination
The Provider may suspend or close the Account in case of breach of the Terms or abusive use of the Service. The User may request closure of the Account at any time. The effects on data are governed by the Privacy policy.
11. Governing law and jurisdiction
The Terms are governed by Italian law. The Court of Rovereto has jurisdiction over any dispute, without prejudice to the mandatory jurisdiction of the consumer's court where applicable.
12. Changes to the Terms and contacts
